Leaked Draft Would Grant Broad Immunity to Trump-Led Gaza Board

If signed by the UN high representative the draft would transfer legal claims and control of public assets in Gaza to internal Board processes.

Overview

  • Over the weekend multiple outlets published a four-page draft resolution identified as Resolution No. 2026/3 that would give Board members, staff, contractors and an international stabilization force wide legal protections for actions in Gaza.
  • The draft would bar “any arrest, detention or legal proceedings in the courts or other entities in Gaza” against those covered and create Section 7, an internal claims process for property loss, injury or death.
  • A separate provision would permit the Board, the office of the high representative and the stabilization force to use public buildings and facilities in Gaza “free of charge” without specifying who must transfer or compensate for those properties.
  • Board officials have said there is no operative immunity framework of the kind reported and the document remains a draft that would only take effect if High Representative Nickolay Mladenov signs it.
  • Lawyers and rights experts warn the plan could remove external legal recourse for Gazans and concentrate accountability inside the Board just as it solicits reconstruction contracts, raising tangible governance and international law risks.
