Kohberger Fights Extra $27K Restitution, Citing Families’ GoFundMe Aid

The court has set a Nov. 5 virtual hearing to decide a sealed request for travel costs that the defense says Idaho law does not require him to pay.

Overview

  • Prosecutors are seeking about $27,330 in additional restitution to cover travel and lodging for Kaylee Goncalves’ parents and Madison Mogen’s mother, with the itemized receipts filed under seal.
  • Kohberger’s attorneys argue the request is not an economic loss under Idaho Code 19-5304 and point to GoFundMe campaigns that raised $73,493, $48,815 and $85,583 for the families’ travel.
  • The defense also says Kohberger cannot pay now or in the future because he is serving four consecutive life sentences plus 10 years in state prison.
  • A filing by the defense notes the state’s request came more than 60 days after sentencing and that the crime victims’ compensation fund already covered $3,000 for urns for Goncalves and Mogen.
  • Kohberger pleaded guilty in July, avoiding the death penalty, and was ordered to pay roughly $290,000 in restitution and related fines before prosecutors sought the new travel-related amount.
