Kashmir NIA Court Issues Non-Bailable Warrant for Pakistan-Based Hizbul Chief Salahuddin

The judge cited prima facie evidence from the case diary with sanction pending to permit a chargesheet toward a possible trial in absentia.

Overview

  • The Special Judge in Budgam directed Jammu and Kashmir Police to execute the warrant and arrest Mohammad Yousuf Shah, also known as Syed Salahuddin.
  • Prosecutors told the court he crossed into Pakistan and is evading arrest, supported by certificates from Budgam Police and the Soibugh police post stating he infiltrated to Pakistan.
  • The case stems from FIR No. 331/2012 with alleged offences under Sections 13, 18, 20 and 39 of the Unlawful Activities (Prevention) Act and Section 506 of the Ranbir Penal Code.
  • The court said the case diary shows sufficient material linking him to the alleged offences, and the original diary has been sent for sanction to enable filing of a chargesheet.
  • Salahuddin leads the banned Hizbul Mujahideen and once chaired the United Jihad Council, with prior designations by the United States and India and earlier attachments of properties linked to him and his sons.
