Karnataka HC Urges Centre to Raise ₹10,000 Cap on Senior Citizen Maintenance

Citing steep inflation, the court says the current limit undermines the Act’s promise of dignity in old age.

  • The High Court set aside a tribunal’s ₹5 lakh lump-sum award as outside the Act’s scope and remitted the case for fresh consideration.
  • The order directs maintenance of ₹10,000 per month from April 2021 and, pending new tribunal orders, requires ₹30,000 per month to each parent from September 2025.
  • The court asked its Registrar to forward the recommendation to the Additional Solicitor General so it reaches the Ministry of Finance for Parliamentary review.
  • Any revision of the cap requires Union or Parliamentary action, and a 2019 proposal to remove the limit was never enacted.
