Judge Removes Maribel Guardia as Guardian of Grandson and Names Addis Tuñón

Placement of custody with a journalist tied to the child's mother raises questions over impartial oversight of the boy's welfare as well as control of his inheritance.

Overview

  • A Mexican judge has taken legal guardianship of José Julián from his grandmother Maribel Guardia and appointed journalist Addis Tuñón, who announced the decision on the TV show De Primera Mano.
  • Maribel Guardia publicly objected to the appointment, saying Tuñón's family ties to the child's mother create a conflict of interest and denying claims that she failed to provide financial support while the child lived with her.
  • Tuñón said she accepted the tutorship after being evaluated as part of a judicial shortlist and has already filed to remove Marco Chacón, Maribel's husband, as albacea, the executor who manages the child's inherited assets.
  • The dispute pivots on control of assets left by the late Julián Figueroa and parts of the Joan Sebastian legacy, with questions over whether the child has received funds owed to him and who should oversee those resources.
  • Maribel has revised her will so the boy will no longer be her universal heir and some assets will be held until he turns 30, and the legal fight over custody, executor duties, accounting and estate access remains active and closely followed by media.
