Judge Orders DHS to Restore Parole for Migrants Processed Through CBP One

The ruling tests the limits of DHS power to cancel humanitarian parole granted under the Biden-era entry system.

Overview

  • U.S. District Judge Allison Burroughs in Boston ordered DHS on Tuesday to reinstate parole for migrants whose temporary status was cut off by mass notices in April 2025.
  • Burroughs vacated the blanket terminations, finding DHS exceeded its legal authority and ignored its own rules by revoking parole without a documented finding that parole’s purposes had been served.
  • The order covers CBP One users who entered between May 16, 2023 and Jan. 19, 2025 and remained in the U.S. after receiving the April email, with reporting placing the affected population at more than 900,000, though many have since left or gained other status.
  • DHS said it disagrees with the decision and labeled it judicial activism, and the administration is expected to appeal, leaving the scope and timing of any restorations uncertain.
  • CBP One, launched in 2023, let asylum seekers book port-of-entry inspections that often led to two-year parole and work permits; the Trump administration shut the app on Jan. 20, 2025 and then warned recipients to leave within seven days, triggering lost work authorization and the threat of removal.
