Overview
- U.S. District Judge Paula Xinis ruled on Feb. 17 that ICE cannot re-detain Ábrego García because the statutory 90-day removal period has lapsed and no deportation is reasonably foreseeable.
- Government filings proposed sending him to Uganda, Eswatini, Ghana or Liberia, and the judge faulted officials for ignoring Costa Rica, which has repeatedly offered to accept him.
- Xinis previously ordered his release in mid-December after finding he had been held without legal authority.
- Ábrego García was mistakenly deported to El Salvador in 2025 and was returned to the United States in June following public pressure and a court order.
- The administration is expected to appeal the ruling, and a separate human-trafficking case in Tennessee remains pending with Ábrego García pleading not guilty.
