Husband Sues Owner, Manager and Barnes & Noble Over Fatal Palm Beach Gardens Stabbing

Claiming years of police calls for loitering, shoplifting and suspicious people made the attack foreseeable, the plaintiff seeks damages as criminal charges proceed.

Overview

  • The suit was filed May 19, 2026 by Jorge Loncharich after his wife, Rita Loncharich, was stabbed inside the Barnes & Noble at Legacy Place on December 22, 2025 and died the same day.
  • The complaint names four defendants: LSREF6 Legacy LLC as owner, Trademark Property Company Florida as property manager, on-site manager Ana Torres, and Barnes & Noble, Inc.
  • Morgan & Morgan cited Palm Beach Gardens Police Department records that list repeated incidents at the store between February 27, 2021 and September 24, 2025, including 16 calls coded "Unwanted Guest," 23 shoplifting calls, and nine "Suspicious Person" calls.
  • The lawsuit alleges that on the morning of the killing the suspect was found sleeping outside Total Wine & More, was asked to be removed, left before police arrived, and later entered Barnes & Noble where he charged his phone and remained before the alleged attack.
  • Criminal charges against the accused, Antonio Moore, remain pending with no trial date set, and the civil suit seeks to hold owners, managers and the retailer accountable for alleged failures in security that the complaint says made the killing foreseeable.
