Germany Flags Widespread Breaches of 12 O’Clock Fuel Price Rule

State enforcement gaps leave many recorded breaches without penalties.

Overview

  • The Mehr‑Tanken analysis published Tuesday found 2,995 of 15,240 stations raised prices at unauthorised times by May 11, logging about 17,000 cases with Bavaria highest at 25.6% and Berlin lowest at 8.2%.
  • The Bundeskartellamt says it records every deviation using fuel price data from its transparency unit and will pass cases to state authorities, though many states have yet to name who can fine offenders.
  • Saxony’s economics minister Dirk Panter announced controls through the state market surveillance office after local figures showed 110 of 589 stations triggered 461 off‑time increases.
  • The rule, in force since April 1, allows only one daily price hike at 12:00 and any number of cuts, and the cartel office reports average daily price changes fell from about 20 to roughly 5 per station.
  • Station groups blame many flags on technical delays in pushing a noon price through cash registers, price boards and pumps, while early academic studies report supplier margins rose by about 6 cents per liter for Super, a cost drivers often feel most around midday.
