First Refunds From Trump-Era Tariffs Expected May 11 as CBP Processes Claims

A Supreme Court ruling voided the IEEPA tariffs, sending refunds to importers through a new CBP portal rather than to consumers.

Overview

  • CBP’s CAPE system, which Judge Richard Eaton said in a Tuesday court filing had accepted about 21% of eligible entries with 3% already in the refund stage, is expected to send the first payments around May 11.
  • The CAPE portal opened April 20 to take phased claims, and CBP says most approved refunds will pay in 60 to 90 days after acceptance, though the site briefly crashed under heavy early traffic.
  • FedEx and UPS say they will pass any refunds straight to customers, with UPS reporting it remitted more than $5 billion in IEEPA duties after processing 16 million entries.
  • Apple said it is applying for refunds and will reinvest any recovery in U.S. manufacturing, while Ford, GM and Stellantis outlined expected recoveries totaling more than $2 billion.
  • Refunds by law go to the importer of record rather than shoppers, so most consumers should not expect direct payments, and separate tariff actions under other trade laws could keep prices elevated.
