FIR Filed in Alleged Assault on Nayagaon Lawyer; Bar Extends Strike Over ‘Unknown’ Accused

The High Court has sought an affidavit from the Punjab DGP on why no case was registered earlier.

Overview

  • After taking suo motu cognisance, Chief Justice Sheel Nagu and Justice Sanjiv Berry noted the complaint disclosed cognisable offences and cited the Lalita Kumari ruling on mandatory FIRs.
  • Punjab informed the bench that Nayagaon police have registered a case against unknown persons, though the complaint alleges involvement of 5–6 CIA-1 Hisar officials.
  • The High Court Bar Association said work abstention will continue until the FIR names the Haryana officers, stronger penal sections are added, and the Nayagaon SHO faces action.
  • The bench urged lawyers to resume work, stressing the impact on litigants and recalling that strike calls by bar bodies have been held impermissible by the Supreme Court.
  • Punjab told the court a show-cause notice has been issued to the Nayagaon SHO for not acting on the complaint, and the court adjourned the matter to December 24.
