Overview
- Brazilian labor law (article 459 of the CLT) requires salaries to be paid by the fifth business day of the month following the work period.
- The legal count treats Monday through Saturday as business days, so the payroll deadline is the fifth business day in the first week of August.
- Collective agreements or company calendars can change that count to Monday–Friday for some categories, which shifts the deadline for those workers.
- Banks do not process bulk TED/agency payments on Saturdays, so employers should schedule credits in advance or use Pix to ensure on-time receipt.
- If employers miss the deadline, workers can seek judicial collection, unions can sue, the TST requires monetary correction for late pay, and labor authorities may fine or investigate employers.
