Federal Judge Orders Malte SRL Removed From ARCA’s List of Untrustworthy Taxpayers

The provisional ruling restores Malte SRL’s CUIT for now and sends the dispute toward appeals while fiscal and criminal probes remain open.

Overview

  • A federal judge in Santiago del Estero granted a precautionary measure on June 20 that directs ARCA to remove Malte SRL from the E-APOC registry and lift all CUIT restrictions within 48 hours.
  • Judge Guillermo Díaz Martínez also declared articles 5 and 10 of Law 26.854 unconstitutional for this procedure, reasoning that ARCA acted without a formal administrative act that would allow the company to defend itself.
  • ARCA said its March inspection found repeated fiscal address changes, difficulty locating the firm, registrations in unrelated activities, shared IP addresses among linked companies, and asset moves that prompted the E-APOC listing.
  • The company is publicly linked to AFA treasurer Pablo Toviggino and holds a VAR contract with the AFA, and it has been tied in reporting to the purchase and transfer of the property known as the 'mansión de Pilar'.
  • ARCA has announced an appeal so the judge’s order is temporary; criminal case No. 19.632/2025 and ongoing fiscal inquiries continue and could restore restrictions or lead to further charges.
