Federal Chamber Orders Casanello to Verify Origin and Authenticity of ANDIS Audios

A split panel reversed an earlier ruling to require a forensic check of the recordings before deciding on their admissibility.

Overview

  • The Buenos Aires Federal Chamber’s Sala II, with Martín Irurzun and Roberto Boico in the majority and Eduardo Farah dissenting, sent the case back for technical tests on the audios attributed to Diego Spagnuolo.
  • The judges said the file does not establish how the recordings were obtained or whether they were edited or generated in part by artificial intelligence, so their status cannot be resolved without peritajes.
  • Judge Sebastián Casanello had rejected new nullity and dismissal requests, but that refusal was revoked so that the court can first determine the recordings’ provenance and integrity.
  • The underlying probe continues: prosecutor Franco Picardi issued a lengthy dictamen seeking multiple indagatorias, and today three executives from Génesis, New Farma and Droguería Floresta declined to testify and will submit written statements.
  • Defense filings argue the audios lack metadata and show cuts and acoustic anomalies; a private expert report added to the file claims 18 edits and possible AI traces, which will be weighed in the ordered forensic review.
