Europe’s Human Rights Court Rejects Swedish Parents’ Case Over Daughters’ Removal

The decision leaves the family without a path in Strasbourg.

Overview

  • The European Court of Human Rights on March 10 declared Daniel and Bianca Samson’s application inadmissible, a final ruling that cannot be appealed.
  • The court cited failure to exhaust legal remedies in Sweden, and a single judge made the admissibility decision, according to the court.
  • The daughters have been in state care since December 2022 after an abuse allegation the eldest later retracted, and prosecutors reportedly found no evidence, according to ADF International.
  • ADF says authorities cited the family’s frequent church attendance as evidence of “religious extremism,” and that despite completing parenting courses and being deemed fit, the parents now receive only one supervised visit per month with the girls placed apart.
  • ADF also reports requests to place the girls in Romania were denied and that Hässleholm officials are pursuing permanent separation and adoption, while the parents say both girls’ health has worsened, including suicide attempts.
