Delhi, Himachal Grant Republic Day Sentence Remissions to Eligible Convicts

The orders rest on BNSS Section 473 with a one-year clean-conduct requirement.

Overview

  • Delhi set tiered cuts of up to 90 days for women and prisoners aged 65 and above and up to 60 days for others, applying to those sentenced by Delhi courts and lodged in central jails within or outside the city as of January 26.
  • The Delhi scheme is in addition to regular remission under the Delhi Prison Rules, allows eligible inmates on parole or furlough if no misconduct is reported, and excludes categories such as death-row cases, detenues, civil prisoners and convictions under NDPS, POCSO, Official Secrets and specified civil offences.
  • Officials say the Delhi remission is expected to benefit around 2,000 convicts, with exclusions also covering cases in MHA-notified exception categories tied to Union List subjects.
  • Himachal Pradesh granted remission to 397 of 1,083 convicted prisoners, setting a separate scale that ranges from 45 days for life or over 10-year terms to seven days for sentences over six months and up to one year.
  • Himachal cited BNSS Section 473, CrPC Section 432 and the state Jail Manual, and it barred beneficiaries including those convicted under NDPS, POCSO, Prevention of Corruption Act, UAPA, terrorism or kidnapping for ransom, as well as habitual offenders and parole-jumpers.
