Delhi High Court Quashes 2019 Sexual Harassment FIR After Settlement, Orders Community Service at Jama Masjid

The order rests on the complainant’s consent alongside a finding that conviction chances were remote.

Overview

  • Justice Anish Dayal directed the two accused to deposit Rs 5,000 each with the Delhi Police Welfare Fund and to serve at Jama Masjid for four hours a day, four days a month, for two months.
  • The case stemmed from a 2019 Bhajanpura police FIR under IPC Sections 354, 354A, 354B, 506, 509 and 34, with an MoU between the parties dated September 9, 2025 recorded in court.
  • The complainant, a relative of the accused, told the court she had no objection to quashing, citing a resolved domestic dispute and the passing of senior family members.
  • The court said conviction prospects were “remote and bleak” and that continuing proceedings would misuse judicial process and burden the state exchequer.
  • Recent Delhi High Court orders have similarly quashed harassment FIRs after settlements, requiring community service at city hospitals, including a Rs 10,000 cost and one month at Lok Nayak Hospital in one case, and two months of weekend service at multiple hospitals in a 2012 matter despite noting grave allegations.
