Delhi High Court Gives Lokpal Final Two Months to Reconsider Sanction in Mahua Moitra Case

The bench set a firm deadline following its earlier ruling that the ombudsman misapplied the Lokpal Act in granting sanction.

Overview

  • The Delhi High Court granted the Lokpal a final two-month extension to decide afresh on sanction for a CBI chargesheet against TMC MP Mahua Moitra, making clear no further extensions will be allowed.
  • Justices Anil Kshetarpal and Harish Vaidyanathan Shankar passed the order after lawyers for both the CBI and Moitra did not oppose the request.
  • The Lokpal sought extra time citing winter holidays, after being directed on December 19 to issue a fresh decision within a month.
  • The court had quashed the Lokpal’s November 12 sanction, finding a misinterpretation of the Lokpal and Lokayuktas Act and the use of extraneous procedures, including inadequate consideration of the public servant’s comments.
  • The CBI registered an FIR on March 21, 2024 and submitted its report in July 2025 on allegations that Moitra shared her Lok Sabha login with businessman Darshan Hiranandani for favors, which he reportedly corroborated and she denies.
