Delhi High Court Declines Stay in Rekha Gupta Assault Trial, Orders Rapid Phone Forensics

The order keeps the case moving by forcing quick phone forensics to test the alleged link between the two accused.

Overview

  • The High Court, which on Wednesday declined to pause the case, directed the Forensic Science Laboratory to examine the accused men’s phones and submit a status report within four weeks.
  • Prosecution evidence is slated to begin on April 25 in the Tis Hazari court, so the trial will continue while the High Court petition remains pending.
  • In December 2025 the trial court framed charges of attempt to murder and criminal conspiracy after citing CCTV footage, call-detail records, alleged video clips sent from the CM’s offices, and a Rs 2,000 transfer between the men.
  • Defense lawyers argue the medical report listed the chief minister’s injuries as simple and say one accused cited a vision of Lord Mahakal, disputing that the facts show a planned attempt to kill.
  • Justice Anup Jairam Bhambhani noted that pressure on the neck can be lethal and set the next High Court hearing for May 21, signaling that the phone analysis could influence how the court views the alleged conspiracy.
