Delhi HC Gives DU Three Weeks to Oppose Late Appeals in PM Modi Degree RTI Case

The bench will first decide whether to condone the late filings before taking up if university records on the prime minister’s 1978 BA are disclosable under the RTI Act.

Overview

  • Chief Justice D K Upadhyaya and Justice Tejas Karia granted Delhi University three weeks to file objections on delay and listed the appeals for April 27.
  • Solicitor General Tushar Mehta, appearing for DU, called the case an attempt to sensationalise the issue and sought time to respond, with the court limiting filings to the delay question for now.
  • The appeals were brought by RTI activist Neeraj, AAP leader Sanjay Singh, and advocate Mohd Irshad, and were filed on November 10 beyond the High Court’s 30‑day window.
  • A single judge on August 25, 2025 set aside a 2016 CIC directive allowing inspection of 1978 BA records, holding that academic records are personal information protected by privacy absent overriding public interest.
  • The appellants argue degree and result details serve public interest and are not held in a fiduciary capacity by universities, and they seek condonation of what they term a short delay of roughly 15 to 45 days.
