Delhi Court Stays Order to Register FIR Against Abhijit Iyer-Mitra

The stay pauses criminal registration pending a Sessions Court review of a magistrate’s finding under India’s new penal code.

  • An Additional Sessions Court in Saket, which issued the stay Monday, blocked an FIR against Iyer-Mitra and listed the case for May 28.
  • Judicial Magistrate Bhanu Pratap Singh had on April 23 said the tweets were sexually coloured remarks and prima facie offences under the Bharatiya Nyay Sanhita’s Sections 75(3) and 79.
  • The magistrate had directed police to register an FIR and investigate because the alleged abuse occurred on X, and the Malviya Nagar SHO filed an action taken report only on February 18 after earlier delays.
  • Newslaundry’s Manisha Pande and other women journalists also filed a defamation suit in the Delhi High Court seeking a public apology and Rs 2 crore in damages, and Iyer-Mitra removed the posts on May 21 after a court reprimand.
  • The stay means no FIR will be registered for now as the Sessions Court weighs the magistrate’s order, while the separate civil defamation case continues.
