D.C. Officer Says He Was Told to Omit Federal Agent’s Gunfire as Lawyers Allege Cover-Up

The case unfolded during the White House crime surge that put federal agents on D.C. patrols.

Overview

  • During an Oct. 17 traffic stop on Benning Road NE, a Homeland Security Investigations agent fired at least three shots at Phillip M. Brown’s SUV, and no injuries were reported.
  • A police report filed in D.C. Superior Court did not mention the gunfire, and an MPD officer testified he was instructed by a supervisor to leave the shooting out of the report.
  • MPD says its internal affairs unit has been investigating the officer-involved shooting since the night of the incident, and a separate internal report documents that inquiry.
  • Brown was jailed for three days on a fleeing charge that a judge later dismissed for insufficient evidence, and a magistrate ordered his release on Oct. 21.
  • Brown’s attorneys released photos showing bullet holes and say MPD has withheld body-camera footage, while DHS says the agent fired “defensive shots” fearing a vehicle attack.
