- On Tuesday the Audiencia Provincial de Madrid suspended the execution of Francisco Nicolás Gómez Iglesias’s latest prison term so he will not enter prison for now.
- The suspension requires payment of €1,800 (six euros a day for 10 months) and a four-year period without committing any crime and will be revoked if those conditions are breached.
- The Fiscalía backed the court’s decision and the judges cited the long time since the offenses and lack of new criminal activity as reasons for choosing a non-custodial measure.
- The Supreme Court cut portions of his earlier penalties on March 26 by applying an attenuating factor tied to procedural delays, which reduced individual terms to levels that made suspension legally possible.
- The underlying convictions include revelation of secrets, active bribery, falsifying documents and unlawful access to police databases and the suspension reflects Spanish rules that allow avoiding short prison terms when courts judge them unnecessary for public safety or resocialization.
