Court Orders Evidence Disclosure in Josh McGuire Child Assault Case

The magistrate set a seven-day deadline for prosecutors to provide key statements needed for a possible bail application.

Overview

  • Deputy Chief Magistrate Anthony Gett directed the brief be disclosed by February 9 after defence said nothing had been provided.
  • Prosecutors told the court they had received much of the brief and sought two weeks to process the material.
  • The matter was adjourned to February 16 for a further mention and McGuire’s bail was continued.
  • Defence lawyer Emma Kearney said two statements, from a child and the child’s mother, are critical to any bid to vary bail.
  • McGuire, 35, is charged with common assault and choking, suffocation or strangulation against a child after a December arrest and he did not appear at Monday’s hearing.
