Court of Appeal Quashes Tower Hamlets Plan to Remove Three LTNs

Judges ruled Lutfur Rahman breached legal duties tied to the borough’s transport plan, keeping the schemes in place as the council seeks permission to appeal.

Overview

  • The decision blocks the removal of low-traffic schemes in Bethnal Green, Shoreditch and Columbia Road, which will remain in operation.
  • The court found a breach of section 151(1)(a) of the Greater London Authority Act 1999 for failing to follow the statutory process to revise the local implementation plan, which requires the Mayor of London’s approval.
  • Two other legal arguments on consultation and procedure were rejected, with Lord Justice Singh, Lord Justice Arnold and Lord Justice Miles ordering a quashing remedy.
  • Transport for London welcomed the judgment and said walking and cycling infrastructure is vital, while noting some LTNs have added local congestion even as most have been successful.
  • The Save Our Safer Streets campaign crowdfunded over £100,000 to bring the appeal, and Tower Hamlets said it is disappointed by the ruling and will seek permission to appeal to the Supreme Court.
