- The Hannover administrative court rejected the AfD Niedersachsen's emergency injunction on Monday, clearing the way for the Lower Saxony Office for the Protection of the Constitution to provisionally list the party as a 'Beobachtungsobjekt von erheblicher Bedeutung'.
- The court said the evidence gathered by the intelligence agency shows a 'verfassungsfeindlich geprägtes Gesamtbild' and cited repeated agitation against human dignity and democracy, including use of terms such as 'Bevölkerungsaustausch', 'Umvolkung' and 'Volkstod' and rhetoric excluding migrants and Muslims.
- By endorsing the upgrade the court gave legal cover for stronger monitoring tools under state law, while noting that agencies must still respect legal limits and that officials have sometimes paused the most intrusive methods during litigation.
- AfD Niedersachsen and state chairman Ansgar Schledde rejected the assessment and said they will appeal to the Higher Administrative Court in Lüneburg, and the wider question of a federal classification of the AfD remains legally suspended in separate lawsuits.
