Convicted Fraudster Seeks Delay to Donate Kidney to Mother Before Serving 15‑Month Sentence

A judge has made any reprieve contingent on an August transplant plus surgical clearance so a longer delay will be allowed only if the operation actually takes place.

Overview

  • Carmine G. Agnello filed court papers July 16–17 asking to push back his July surrender and report to prison on Sept. 18 so he can donate a kidney to his mother.
  • Two doctors’ declarations state a nephrectomy is scheduled for August 3 with Victoria Gotti identified as the intended recipient and Agnello as the donor.
  • Federal prosecutors, noting a prior March adjournment for a transplant that never occurred, said they are skeptical but consented to a brief deferment to August 10 unless the surgery happens.
  • At a virtual conference the judge set a conditional schedule that allows reporting on Sept. 18 only if the transplant occurs and the surgeon clears Agnello, otherwise he must surrender by August 10; the Bureau of Prisons said it can accept him once he is cleared.
  • Agnello pleaded guilty in 2024 to wire fraud tied to roughly $1.1 million in COVID‑19 SBA loans and was sentenced to 15 months with restitution, and court filings note that Victoria is the only known compatible donor and that a separate recent state domestic‑violence arrest has shaped prosecutors’ objections.
