CFTC Proposes Voluntary Federal Rules for Leveraged Crypto Trading

It opened a public comment process to create an opt-in federal route that would require proof-of-reserves plus futures-broker intermediation for exchanges offering margined or financed retail crypto trades.

Overview

  • On Oct. 5, 2026 the Commodity Futures Trading Commission published an advance notice for Regulation CTX and Regulation CAM and opened a roughly 60-day public comment window.
  • The package targets retail crypto transactions that use leverage, margin, or financing and would let exchanges register as a new ‘crypto asset market’ under tailored CFTC rules.
  • Proposed safeguards include proof-of-reserves for pooled custody, anti-manipulation and listing standards, and routing customer trades through registered futures commission merchants to bring capital, segregation and AML rules to those accounts.
  • Participation would be voluntary so ordinary cash spot trading would largely stay under state money-transmitter rules while the CFTC aims to lure offshore activity back by offering regulated access to retail leverage.
  • Next steps are OIRA review, Federal Register publication, formal proposed rules and likely legal and political challenges that will determine whether the agency’s approach stands or requires congressional action.
