CBP Sets May 12 Start for IEEPA Tariff Refunds After Supreme Court Ruling

Officials have signaled replacement duties could return by July.

Overview

  • CBP, which on Monday announced May 12 for the first Automated Clearing House refunds, also released ACE status tools so claimants can track processing.
  • The Supreme Court in February ruled the IEEPA sanctions law cannot authorize tariffs, triggering repayment of up to $166 billion collected from importers.
  • Phase one of the CAPE portal covers roughly 60 to 63 percent of entries.
  • CBP excludes entries in disputes or tied to drawback, protests or Section 122, 232 or 301 duties.
  • The government has until about June 7 to appeal to the Federal Circuit, which trade lawyers say could pause refunds.
