Cassation Acquits Col. Sabatino in Cucchi Cover-Up Case

The ruling closes the depistaggi proceeding, crystallizing two convictions alongside three prescriptions.

Overview

  • Italy’s Supreme Court cleared Carabinieri Col. Lorenzo Sabatino with the formula “perché il fatto non sussiste,” after he had renounced the statute of limitations.
  • The Procura generale, through deputy prosecutor Tomaso Epidendio, had urged annulment without referral for Sabatino and sought to reject or deem inadmissible the other appeals.
  • Judges rejected the appeals of defendants whose second-instance outcomes were convictions or prescriptions, confirming that Alessandro Casarsa, Luciano Soligo and Francesco Cavallo remain prescribed.
  • The only convictions that stand are Francesco Di Sano at 10 months and Luca De Cianni at two years and six months, while Massimiliano Colombo Labriola and Tiziano Testarmata were previously acquitted on appeal.
  • The case stems from alleged institutional depistaggi after Stefano Cucchi’s 2009 death, with Ilaria Cucchi denouncing those involved for years of failed justice.
