California Father Sentenced to One Year for Incest After Daughter’s Suicide

The outcome has drawn sharp objections from prosecutors and the victim’s family because an internal review found incest was the only felony charge supported by admissible evidence.

Overview

  • A Ventura County judge on June 23 sentenced Stephen Vincent Chavez to one year in county jail, three years of felony probation, and 20 years of sex-offender registration after he pleaded guilty to felony incest and providing alcohol to a minor.
  • Prosecutors say the July 2025 incident began after a family gathering when Chavez bought additional alcohol for himself and his 18-year-old daughter, who was later hospitalized and whose rape kit showed Chavez’s DNA.
  • Chavez pleaded guilty on May 18 and admitted special allegations that he exploited a position of trust and that the victim was particularly vulnerable.
  • District Attorney Erik Nasarenko ordered a comprehensive review by ten in-office prosecutors and outside experts, who concluded that evidence and admissibility rules left incest as the only felony that could be proven in court.
  • Makayla Settles’s family and prosecutors sought the three-year state prison maximum and have publicly objected to the sentence while critics point to this case as an example of how statutory limits and evidentiary rules can constrain prosecutions when a victim dies.
