Brother’s False Confession Revived 1995 Van Den Hurk Case, Produced DNA Link but No Murder Conviction

A staged confession led to an exhumation that uncovered DNA evidence yet resulted only in a rape conviction.

Overview

  • Andy van den Hurk posted a fabricated Facebook confession in March 2011, was arrested in the UK and extradited, then freed five days later when no evidence tied him to the crime.
  • Nicole’s remains were exhumed in September 2011, and testing found DNA from her then-boyfriend and an unidentified male profile.
  • The unidentified DNA matched convicted rapist Jos de G, who had prior offenses including an attack resembling Nicole’s case.
  • Prosecutors charged de G in April 2014, but after the defense argued the DNA could stem from consensual contact, he was cleared of homicide and sentenced to five years for rape.
  • The Dutch Supreme Court upheld de G’s five-year sentence in June 2020, leaving Nicole van den Hurk’s murder officially unsolved.
