Bronx Daycare Operators Get 25 Years to Life for Toddler’s Fentanyl Death

The state sentence runs concurrently with their existing 45-year federal term for a fentanyl trafficking case tied to the same daycare.

Overview

  • Grei Mendez, 38, and Felix Herrera-Garcia, 37, were sentenced Wednesday in state court after a jury convicted them of second-degree murder in November 2025.
  • The case stems from a Sept. 15, 2023 exposure at a Bronx home daycare that hospitalized four children; 22-month-old Nicholas Dominici died.
  • Prosecutors say the Divino Niño Daycare operated inside a Bronx apartment doubled as a fentanyl packaging and distribution site.
  • District Attorney Darcel Clark said drugs were hidden under the floor where children napped and described the victims as being used as shields for the operation.
  • Federal courts had already imposed 45-year narcotics sentences on both defendants related to the trafficking that led to the child’s death.
