Overview
- Chief Judge Nancy W. Salomone denied the defense request to obtain early JonBenét Ramsey investigation records, warning the material would be a “worm can” with little relevance to Michael Clark’s case.
- Defense attorney Adam Frank had issued 12 subpoenas, including for records from the first 48 hours of the Ramsey probe and CBI policies and data on invalid or undetermined DNA tests from 2009 to 2011.
- The Boulder County District Attorney’s Office asked the court to void all 12 subpoenas, arguing the Ramsey-related requests and some CBI materials are not pertinent to the Grisham murder prosecution.
- Frank contends Boulder police made “colossal mistakes” in both the Ramsey and Marty Grisham investigations, a claimed pattern he argues supports Clark’s innocence.
- Clark’s 2012 conviction was vacated in April after independent DNA testing diverged from trial evidence linked to former CBI scientist Yvonne “Missy” Woods, and prosecutors plan a May jury retrial with Clark currently free on bail.
