Berlin Passes Law to Permanently Protect 56,000 State-Owned Allotment Gardens

The measure sets preservation as the default for state-owned allotments with narrow, legislature-approved exceptions.

Overview

  • The Abgeordnetenhaus approved the law with votes from CDU, SPD, Greens and Left, while AfD opposed it.
  • Roughly 56,000 garden plots on state land, covering about 2,283 hectares, fall under the new protections.
  • Conversions are limited to tightly defined public-interest projects such as affordable housing, schools, day-care centers or hospitals and generally require parliamentary approval.
  • Gardeners displaced by an approved project must be offered nearby replacement plots of comparable size.
  • Paths within allotment sites must remain publicly accessible year-round, and about 14,000 plots on non-state land are not covered.
