Autopsy Points to Airway Error in Dental-Implant Death as Two Clinicians Face Negligent-Homicide Charges

Prosecutors in Buenos Aires are advancing forensic tests under Judge Érica Uhrlandt after the family’s lawyer reported esophageal injuries consistent with a misplaced intubation.

Overview

  • Odontologist José Miguel Galiano and clinic owner–plastic surgeon Marcelo Fernando Robles are formally charged with homicidio culposo and remain free while the case proceeds.
  • The family’s lawyer says the autopsy found traumatic hemorrhages in the posterior tongue, pharynx and larynx, plus an almost 5 cm esophageal laceration suggestive of an esophageal intubation.
  • The investigation is being handled by Juzgado Nacional en lo Criminal y Correccional Nº 53 with prosecutor Laura Belloqui/Bellocqui of Fiscalía Nº 5 directing additional pericias.
  • Prosecutors have ordered a preliminary autopsy review, toxicology testing and odontological analyses to establish medical causation and potential responsibility.
  • Miguel Ángel Berlini, 64, died on November 19 during a scheduled implant procedure at Clínica Robles in Belgrano, and his sister has been accepted as a querellante after alleging delayed, evasive communication and recounting a reported 40–50 minutes of CPR.
