Overview
- The Health Ministry published Resolución 796/2026 in the Boletín Oficial on Monday, July 6, 2026, replacing the 2012 annex and revoking the 2019 and 2021 packaging rules.
- The rule requires a sanitary message to occupy 50% of one principal surface and an image to occupy 50% of the opposite principal surface on product packaging.
- Electronic cigarettes, heated-tobacco devices and nicotine pouches must carry the single warning: “Este producto contiene nicotina que es altamente adictiva.”
- The resolution clarifies that vaping and use of heated-tobacco devices are banned where smoking is prohibited and updates point-of-sale signage to reflect that rule.
- Manufacturers and importers have 180 days to comply, authorities will use existing sanitary policing powers to sanction noncompliance, and the Ministry added a WhatsApp chatbot to offer cessation information and accept complaints.
