Argentina Asks Inter-American Court to End Milagro Sala’s House Arrest

The Justice Ministry says she violated monitoring rules and argues the 2017 measure has become an unjust privilege.

Overview

  • The Ministry of Justice formally reiterated on February 5 its request to the Inter-American Court of Human Rights to revoke the 2017 order that keeps Milagro Sala under house arrest so she serves her term in a regular prison.
  • Officials said they submitted documentation alleging Sala changed location without judicial authorization, triggering electronic monitoring alerts, and they rejected the defense’s claims of judicial harassment.
  • Sala holds a final 15-year sentence and absolute disqualification for association ilícita, fraud against the public administration, extortion and threats, a judgment left firm by Argentina’s Supreme Court in May 2025.
  • She has been hospitalized at the Hospital de Gonnet since January 12 and, having completed two-thirds of her term last month, is eligible under the Penal Code to apply for conditional release.
  • The Milei administration frames the push as part of a policy to end perceived privileges for convicted leaders while stating Argentina continues to meet its international obligations.
