Aguinaldo Deadline Hits in Mexico as Unpaid Workers Move to File Claims

Workers can seek free legal support from Profedet to pursue conciliation before the CFCRL.

Overview

  • By law, employers must pay the annual bonus by December 20, with a minimum equal to 15 days of pay and a proportional amount for those who worked part of the year.
  • Profedet’s method to calculate the benefit is to divide monthly salary by 30 to get the daily wage and multiply that figure by 15.
  • If the payment was not made by the cutoff, employees can immediately contact Profedet for free guidance and representation, with cases brought to the CFCRL to seek a settlement.
  • Workers have one year to file a claim for the full or proportional payment, and employers who fail to comply face fines of 50 to 5,000 UMA under the Federal Labor Law.
  • INEGI data indicate 22.3% of the labor force—about 14.4 million people—does not receive this benefit; payments must be in legal tender or a consented electronic transfer, and amounts above 30 UMA are subject to income tax.
