- Six Minnesotans filed the suit Thursday in federal court in Washington, D.C., seeking to block a 2025 ICE policy and have it declared unconstitutional.
- The complaint centers on a May 2025 “Home Entry Memo” by acting ICE Director Todd Lyons that told agents they could rely on Form I-205, an agency-signed removal warrant, to enter private homes without a judge.
- The memo surfaced after a January leak and, according to a former ICE attorney’s Senate testimony, was shown to trainees in secret with instructions not to take notes.
- Plaintiffs describe raids in Minnesota in December and January where masked agents used a battering ram, pointed rifles at family members, and arrested people inside homes without a judicial warrant.
- A federal judge has already ruled one arrest violated the Fourth Amendment and ordered a detainee’s release, DHS has defended administrative warrants as lawful, and Secretary Markwayne Mullin now says agents will use judge-signed warrants going forward.
